Implied Consent
Employees, students, and their guests may be photographed or videotaped in group settings on campus and at university-sponsored events. These images may appear in on or off-campus publications and other forms of media. The university presumes implied photo consent from employees, students, and their guests for such appearances. Written consent is typically obtained for an individual testimonial or an exclusive appearance used for promotional purposes. If an employee, student, or guest does not wish his or her image to be used under any circumstances, it is that person's responsibility to inform the photographer/videographer at the time of the recording or photography that they wish not to appear.
Note, these instances do not require prior consent:
- Any event to which the public is invited (e.g., commencement, campus-wide events, etc.);
- Anyone appearing in any outdoor space on campus or place in which permission is not needed to enter; or
- Bystanders appearing unintentionally in the background or any person whose identity is unclear or obscured.
